Remarks by President Biden on Protecting American Consumers from Junk Fees

Although it has transitioned to a more information- and service-based economy in the 21st century, it remains an industrial state, ranking seventh in GDP as of 2019, with the third largest manufacturing sector and second largest automobile production. We present results for non-Hispanic whites, who account for 41 percent of the state’s adult population, and also for Latinos, who account for about a third of the state’s adult population and constitute one of the fastest-growing voter groups. We also present results for non-Hispanic Asian Americans, who make up about 16 percent of the state’s adult population, and non-Hispanic African Americans, who comprise about 6 percent. Results for other racial/ethnic groups—such as Native Americans—are included in the results reported for all adults, registered voters, and likely voters, but sample sizes are not large enough for separate analysis. Results for African American and Asian American likely voters are combined with those of other racial/ethnic groups because sample sizes for African American and Asian American likely voters are too small for separate analysis.

These districts are 3, 9, 13, 22, 27, 40, 41, 45, 47, and 49; a map of California’s congressional districts can be found here. With about two weeks to go before Governor Newsom’s bid for reelection, a majority of Californians (54%) and likely voters (52%) approve of the way he is handling his job, while fewer disapprove (33% adults, 45% likely voters). Approval was nearly identical in September (52% adults, 55% likely voters) and has been 50 percent or more since January 2020.

Why are people unbanked or underbanked?

Since the 2010 midterm elections, Ohio's voter demographic has leaned towards the Republican Party. The governor, Mike DeWine, is Republican, as are all other non-judicial statewide elected officials, including Lieutenant Governor Jon A. Husted, Attorney General Dave Yost, State Auditor Keith Faber, Secretary of State Frank LaRose and State Treasurer Robert Sprague. In the Ohio State Senate the Republicans are the majority, 25–8, and in the Ohio House of Representatives the Republicans control the delegation 64–35. Census Bureau, the total number of people employed in 2016 was 4,790,178. The total number of unique employer establishments was 252,201, while the total number of non-employer establishments was 785,833. In 2010, Ohio was ranked second in the country for best business climate by Site Selection magazine, based on a business-activity database.

These kinds of challenging times are exactly when you want to prepare yourself to be the innovators … to reinvigorate and reinvest and drive growth forward again. We've seen so many customers who have prepared themselves, are using AWS, and then when a challenge hits, are actually able to accelerate because they've got competitors who are not as prepared, or there's a new opportunity that they spot. We see a lot of customers actually leaning into their cloud journeys during these uncertain economic times.

In the last year, the CFPB has also published several research reports on overdraft fees and an analysis of college banking products. Today’s Consumer Financial Protection Circular on surprise overdraft fees and the CFPB’s compliance bulletin on surprise depositor fees lay out when a financial institution’s back-end penalties likely break the law. – Today, the Consumer Financial Protection Bureau issued guidance about two junk fee practices that are likely unfair and unlawful under existing law. The first, surprise overdraft fees, includes overdraft fees charged when consumers had enough money in their account to cover a debit charge at the time the bank authorizes it.

California’s Likely Voters

Approval is higher in the San Francisco Bay Area and Los Angeles than in the Inland Empire, Orange/San Diego, and the Central Valley. About half or more across demographic groups approve of President Biden, with the exception of those with some college education (44%). When asked how they would vote if the 2022 election for the US House of Representatives were held today, 56 percent of likely voters say they would vote for or lean toward the Democratic candidate, while 39 percent would vote for or lean toward the Republican candidate. In September, a similar share of likely voters preferred the Democratic candidate (60% Democrat/lean Democrat, 34% Republican/lean Republican). Today, overwhelming majorities of partisans support their party’s candidate, while independents are divided (50% Democrat/lean Democrat, 44% Republican/lean Republican).

But I think there are many judges who are trying to make the judiciary more accessible, and so people can see the work that we're doing and understand what we're doing and then make their own opinions about if it's right or wrong. But at least, if it's understandable, then there's still some trust in the framework even if you don't agree with how our decisions are stated. Our U.S. attorney at the time, Jessie Liu, had this idea of using financial investigations in a way that was not limited to just white collar crime, or even narcotics cases, but also for cyber investigations, to national security investigations, and in civil cases. A lot of what we were investigating was related to following the money and so she wanted us to be this multidisciplinary unit. While regulators and companies can occasionally come into conflict, the agencies also serve an important role in providing rules of the road and certainty for business models. If the decision casts further uncertainty around CFPB’s existing regulation, that’s probably bad for business.

I do a lot of work with the Administrative Office of the Courts, our central body doing civic education and outreach to high schools, because I want college and high school students and law students to have an experience where they get a chance to talk to a judge.

About a quarter of adults (3% excellent, 20% good) and likely voters (2% excellent, 23% good) feel positively about the national economy. Strong majorities across partisan groups feel negatively, but Republicans and independents are much more likely than Democrats to say the economy is in poor shape. Solid majorities across the state’s major regions as well as all demographic groups say the economy is in not so good or poor shape.
